1. Description of Service
CanaryOps is an API monitoring service that checks the availability and performance of third-party APIs and notifies users when issues are detected. The Service is provided "as is" and is intended for informational and operational purposes only.
2. Accounts
To use certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Providing accurate and current information
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Subscriptions and Billing
Free Tier
The free tier provides limited access to the Service at no cost. We reserve the right to modify free tier limits at any time.
Paid Subscriptions
Paid subscriptions are billed monthly in advance. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis until you cancel.
Prices are subject to change with 30 days' notice. Changes will apply to the next billing cycle after notice is given.
Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period, except as outlined in our Refund Policy.
4. Acceptable Use
You agree not to:
- Use the Service to violate any laws or regulations
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Use the Service to monitor endpoints you do not own or have permission to monitor
- Resell or redistribute the Service without our written consent
- Use automated means to create accounts or abuse free tier limits
5. Intellectual Property
The Service, including its design, features, and content, is owned by CanaryOps and protected by applicable intellectual property laws. You retain ownership of any data you submit to the Service.
6. Data and Privacy
We collect and process data as described in our Privacy Policy. By using the Service, you consent to such processing.
You are responsible for any data you input into the Service, including URLs and endpoint configurations.
7. Third-Party Services
The Service monitors third-party APIs and services. We are not affiliated with, endorsed by, or responsible for any third-party service. Monitoring results reflect observed behavior and may not match official status pages.
8. Service Availability
We aim to provide reliable service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We are not liable for any damages resulting from service interruptions or inaccurate monitoring results.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
10. Indemnification
You agree to indemnify and hold harmless CanaryOps and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
11. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
12. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason with reasonable notice.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will remain in effect.
13. Governing Law
These Terms are governed by the laws of Israel. Any disputes shall be resolved in the courts of Israel.
